How to enter the Contest
Contest begins March 14, 2008. Enter by completing the entry form on-line at the Ensemble Travel consumer website or on the website of your participating Ensemble Travel agency and click where directed to forward the entry electronically. One entry per person. All entries must be received by agency closing time, April 30, 2008, the contest closing date. Ensemble Travel is not responsible for any entries destroyed, mutilated, lost or misdirected. No purchase necessary. Although online access and an e-mail account are required in order to participate in this contest, no purchase of any kind is required. Many public libraries, retail businesses and others offer free access to computers and a number of Internet service providers and other companies offer free e-mail accounts.
To enter ”The Colours of Spain” contest, individuals are required to provide their correct e-mail address, first and last name, complete address including postal code, phone number and age bracket. In addition we may collect certain personal, usage and purchase information. All information collected at any of the participating agency websites for this contest is protected against unauthorized access. By using the entry websites you consent to collection and use of this information by Ensemble Travel and/or its participating agencies.
Ensemble Travel and/or its participating agencies will not willfully disclose individually identifiable information about a contestant to any third party without first receiving a contestant's permission. ENSEMBLE and/or its participating agencies will not share or sell a contestant's personal information to other companies, organizations or individuals.
Prizes
There will be a total of one (1) prize available to be won. The prize will consist of a $1,000 (CAD) credit for use on any Transat Holidays trip for two (2) or more, courtesy of Transat Holidays and the Ensemble Travel Group. If the value of the chosen trip (including taxes) exceeds the $1,000.00 (CAD), the additional expenses are the responsibility of the winner and his or her traveling companion. Such items as roundtrip airfare between the winner's home and the departure city, transportation and security-related taxes, airport fees, currency, energy or fuel surcharges (if any), meals, beverages, gratuities and any other charges of a personal nature are not included and are the responsibility of the winner and his or her traveling companion(s). Travel must be completed by April 30, 2009. Some blackout periods may occur and travel must be booked through the winner's entry-submitting travel agency. Subject to availability as determined by Transat Holidays. Retail value: $1,000.00 (CAD.). All travel documentation (such as a passport) is the responsibility of the winner and his or her traveling companion and must be obtained prior to departure. The prize must be accepted as awarded, has no cash value, cannot be transferred, substituted or redeemed. Any extensions or additions to the trip requested by the winner will be at the expense of the winner and/or his or her traveling companion. If the value of the chosen trip is under $1,000.00 (CAD) , the remaining credit will not be awarded to the winner in the form of cash or credit. All decisions of the judges are final.
How to win
A random draw will be held in each participating travel agency May 1, 2008 for one (1) selected entrant. Those names will be submitted to the independent judging organization who will conduct a random draw from all these names in North Vancouver, BC on May 5, 2008. Chances of winning will be dependent upon the number of eligible entries received from the participating travel agencies and the Ensemble Travel consumer website. In order to win, the selected entrant must first correctly answer the time-limited mathematical, skill-testing question administered by mail. In order to be declared a winner, the selected entrant must first sign a Winner's Affidavit and a Winner's Agreement (including a Publicity Release), agreeing to the use of his or her name, photo, voice and/or statements without compensation other than the prize offered. The traveling companion must be over the age of 18 and must also sign an Affidavit and Publicity Release. By entering the contest, the entrants agree to be bound by the rules of the contest and agree to the decisions of the independent judging organization with respect to all aspects of this contest. All residents of Canada are eligible to win, providing they are over the age of majority in the province in which they live on March 14, 2008 and providing that they are not employees of The Ensemble Travel Group, Transat Holidays and the participating travel agencies, their advertising or promotional agencies or the independent judging organization or family members with whom these employees are domiciled. All entries become the property of The Ensemble Travel Group.
Ensemble Travel reserves the right to substitute another prize of equal or greater value should this prize become unavailable for any reason and to cancel this promotion at any time for any reason whatsoever including, but not limited to, printing or production errors pertaining to the contest promotional materials, unavailability of the prize due to situations with prize suppliers which are beyond the reasonable control of Ensemble Travel or if any virus, bug or other cause beyond the reasonable control of Ensemble Travel or its participating agencies corrupt the security or proper administration of the contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and, should such an attempt be made, Ensemble Travel and its participating agencies reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
Ensemble Travel and their participating agencies are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any entry to be received by Ensemble Travel or their participating agencies on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to the entrant's or any other person's computer, related to or resulting from downloading any materials in this promotion. Ensemble Travel and their participating agencies reserve the right, in their sole discretion, to modify the contest rules without materially affecting the terms and conditions of the contest.
Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Regie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Regie only for the purpose of helping the parties to reach a settlement. The contest is subject to all Federal, Provincial and Municipal regulations and is void where prohibited by law.
